Pivotal Health Solutions Limited Warranty - Chiropractic Products

WARRANTY OVERVIEW   
Pivotal Health Solutions warrants to the original retail purchaser that it will repair or replace components of the domestic and international products manufactured by Pivotal Health Solutions (except for components not warranted under "Exclusions") that are defective in material or workmanship under normal use and service. Pivotal Health Solutions obligation under this warranty is limited to the repair or replacement, at Pivotal Health Solutions option, of the applicable components. This limited warranty shall only apply to defects that are reported to Pivotal Health Solutions within the applicable warranty period and which, upon examination by Pivotal Health Solutions, prove to be defective. This warranty extends only to the first retail purchaser of a product, and is not transferable or assignable.

APPLICABLE WARRANTY PERIOD
The applicable warranty period, measured from the date of delivery to the original user, shall be one (1) year for all warranted products and components.

OBTAINING WARRANTY SERVICE
Warranty service must be obtained through either Pivotal Health Solutions or an authorized dealer in the PHS product line for which warranty service is requested. Pivotal Health Solutions may be contacted for warranty service inquiries or issues via email at info@pivotalhealthsolutions.com, by phone at 1-800-743-7738, or by mail to Pivotal Health Solutions, Inc., 724 Oakwood Road, Watertown, South Dakota 57201

It is the retail purchaser’s obligation to arrange for delivery of a product to Pivotal Health Solutions or one of its authorized dealers for warranty service, which delivery shall be at retail purchaser’s expense. It is also the retail purchaser’s obligation to comply with the warranty service instructions provided either by Pivotal Health Solutions or its authorized dealer. The retail purchaser must provide Pivotal Health Solutions with completed warranty registration information within thirty (30) days after purchase in order to obtain the benefits of this warranty.

WARRANTY PARTS:
To request parts covered under warranty, call Customer Service at 800-743-7738.  Please provide the table serial number and end customer information when calling.  Replacement part(s) will be sent out and your credit card will be charged.  All warranty parts will be shipped with a RETURN UPS label and a RETURNED PRODUCT REFUND FORM.  If the product is deemed defective, Pivotal Health will issue credit.  No credit will be issued if the returned product is not defective.  To receive proper credit, warranty parts need to be returned to Pivotal Health within 45 days of shipment and must be accompanied with the RETURNED PRODUCT REFUND form.

EXCLUSIONS
This warranty does not cover and Pivotal Health Solutions shall not be liable for the following:

(1) defects, damage, or other conditions caused, in whole or in part, by misuse, abuse, negligence, alteration, accident, freight damage, tampering, or failure to seek and obtain repair or replacement in a timely manner
(2) products which are not installed, used, and properly cleaned and maintained as required in the Pivotal Health Solutions "Installation" and/or "Installation/Operation Manual" for the applicable product.
(3) products considered to be of a consumable nature
(4) accessories or parts not manufactured by Pivotal Health Solutions

(5) charges by anyone for adjustments, repairs, replacement parts, installation, or other work performed upon or in connection with such products which are not expressly authorized in writing in advance by Pivotal Health Solutions
(6) costs and expenses of routine maintenance and cleaning
(7) representations and warranties made by any person or entity other than Pivotal Health Solutions.

EXCLUSIVE REMEDY; CONSEQUENTIAL DAMAGES DISCLAIMER:
Pivotal Health Solutions’ only obligation under this warranty is the repair or replacement of defective parts. Pivotal Health Solutions shall not be liable for and hereby disclaims any direct, special, indirect, incidential, exemplary, or consequential damages or delays, including, but not limited to, damages for loss or profits or income, loss of use, downtime, cover and employee or independent contractor wages, payments and benefits.

NO AUTHORIZATION
No person or firm is authorized to create or approve for Pivotal Health Solutions any other obligation or liability in connection with the products.

WARRANTY DISCLAIMER:
This warranty is Pivotal Health Solutions’ only warranty and is in lieu of all other warranties, express or implied. Pivotal Health Solutions makes no implied warranties of any kind including any implied warranties of merchantablity or fitness for a particular purpose. This warranty is limited to the repair or replacement of defective parts.

STATUTE OF LIMITATIONS
No action may be brought against Pivotal Health Solutions for breach of this limited warranty, an implied warranty, if any, or for any other claim arising out of or relating to the products, more than ninety (90) days following expiration of the limited warranty period.


 

Pivotal Health Solutions  Warranty - Massage/Spa/Therapy Products

LIFETIME WARRANTY OVERVIEW   
The Pivotal Health Solutions Lifetime Warranty applies only to domestically produced portable massage tables. These Pivotal Health Solutions products are guaranteed to be free from defects in material and workmanship to the original customer and are not transferrable. Our warranty is valid with proof of purchase. Table accessories and other Pivotal Health Solutions products carry different warranty timelines. Please consult the Warranty Guide or contact Customer Service for more details. Pivotal Health Solutions, at our choice, may elect to provide parts, replace or repair any of our products covered by this warranty.

Our warranty does not include damages caused by improper set-up, accidents, improper storage, misuse, or tears or cracks in the upholstery. Warranty does not  cover normal wear and tear on items such as lost knobs, worn rubber feet or damaged  upholstery due to use of improper  or harsh cleaning solutions. The customer shall be responsible for the proper set-up and use of the product. Under no circumstances is Pivotal Health Solutions liable for any direct or indirect costs or damages.

Our warranty is invalid and our liability terminates if modifications or repairs are made to the product without the authorization of Pivotal Health Solutions.

Pivotal Health Solutions reserves the right to inspect claimed defective products. No returns, replacements or repairs may be made without prior written consent. Please do not return any product to Pivotal Health Solutions without first contacting Customer Service for a Return Authorization number. Products returned without a Return Authorization number will be refused back to the customer at their expense.

Some replacement parts may vary from those originally supplied and are subject to availability. Customized or discontinued products and options may not be available for replacement.

In the event of warranty-related returns and exchanges, after 1 year of purchase, the customer is responsible for shipping product back to Pivotal Health Solutions. Pivotal Health Solutions will provide return shipping back to the customer within the continental U.S. in accordance with the Pivotal Health Solutions Warranty Guide. The customer is responsible for return shipping charges of stationary and lift tables.

International Customers should consult the Pivotal Health Solutions Warranty Guide since the international warranty may vary from the U.S. warranty.

The warranty outlined herein is the sole and exclusive lifetime warranty provided by Pivotal Health Solutions. There are no other warranties or guarantees provided by Pivotal Health Solutions, either expressed or implied, including any warranties of merchantability or fitness for a particular use. Incidental or consequential damages
are excluded. We do not assume any other liability in connection with the sale of our product.

For all other products, please reference the invoice number found on your packing slip or invoice.


30 DAY SATISFACTION GUARANTEE & SHIPPING DAMAGE SATISFACTION GUARANTEE

If you are not completely satisfied with a Pivotal Health Solutions product, call us at
800-627-2387 or e-mail massageinfo@pivotalhealthsolutions.com within 30 calendar days of receipt of your product. Please have your invoice or packing slip number handy as we will need it to reference your order and expedite your claim process.

Once a claim is approved, you will be assigned a Return Authorization number provided by our Customer Service Staff. Please write this prominently on the outside of your box. Products without a Return Authorization Number provided by Pivotal Health Solutions will not be accepted.

All products must be returned to Pivotal Health Solutions in the original packaging in new condition. Upon receipt of the product in new condition, our customer will be refunded the original purchase price, less shipping charges. Our customer is responsible for all return shipping costs associated with this 30-day guarantee. Our customer is responsible for the correct repackaging of the product. We recommend that you use a traceable shipping service and insurance coverage to avoid damage or lost returns. Products damaged or lost in shipping are our customer’s responsibility.

Products custom manufactured with special order features are only returnable due to a manufacturers’ defect. Rush production fees, expedited shipping costs and any special order charges are not refundable.

Due to health and safety regulations, linens, fleece pads, table warmers, oils, lotions, creams and disposables are returnable and refundable only if they are returned unopened or due to manufacturers’ defect.


SHIPPING DAMAGE

If you notice that your product packaging appears damaged and you suspect ship damage, notify your delivery driver immediately, and write “damaged” along with your signature. Contact Pivotal Health Solutions immediately so we can assist you with the freight claim process.

Retain all original packaging, as ship damage claims cannot be processed without the original packaging. Even if your product appears undamaged, please inspect the contents of your package carefully before throwing away the packaging materials. Although we will make every effort to assist you with the claim process, Pivotal Health Solutions cannot be responsible for replacement of freight damaged in transit.
Customer is responsible for all shipping charges associated with a customer refused delivery of product.
